This website is operated by Vector Painter, OSVČ Ivan Bilous.

Throughout these Terms of Service, the terms “Vector Painter”, “we”, “us” and “our” refer to OSVČ Ivan Bilous.

Vector Painter provides this website, digital products, downloadable files, licenses, online tools, browser-based software, subscription services, information and customer support subject to these Terms of Service.

By visiting the website, creating an account, purchasing a product, starting a subscription, downloading a file or using any Vector Painter digital service, you agree to these Terms of Service and any additional policies or terms referenced in them.

If you do not agree to these Terms, you must not purchase or use our products or services.

These Terms apply to website visitors, registered users, customers, subscribers, business customers and any other users of the website or Services.

Our store is hosted by Shopify Inc., which provides the e-commerce platform used to sell our products and services.

If there is a conflict between these general Terms and specific terms clearly presented for a particular product, license or subscription before purchase, the specific product, license or subscription terms will apply to that product or service.

Nothing in these Terms limits mandatory consumer rights that cannot legally be waived.

ELIGIBILITY AND AGE REQUIREMENTS

You must be at least the age of legal majority in your country or region to create an account or make a purchase.

In the Czech Republic, the age of legal majority is 18 years.

If you allow a minor to use a product or Service under your supervision, you remain responsible for the minor’s use and for compliance with these Terms.

You may not use the website, products or Services for any illegal or unauthorised purpose.

CUSTOMER ACCOUNTS

Some products and Services require a Vector Painter customer account.

You agree to:

Provide accurate and current information.
Use an email address that you can access.
Keep your login credentials confidential.
Promptly update information that changes.
Accept responsibility for activity performed through your account.
Notify us at info@vector-painter.com if you suspect unauthorised access.

Unless expressly stated otherwise, an account and subscription are intended for one customer and may not be shared, transferred, rented or resold.

We may request reasonable information to verify account ownership, purchase history or license validity.

We may temporarily restrict access where reasonably necessary to investigate fraud, unauthorised use, security risks, account sharing or payment problems.

PRODUCTS AND SERVICES

Vector Painter may offer:

One-time downloadable digital products.
SVG, DXF, AI, CDR and other vector files.
PDF instructions and related digital documentation.
Personal and commercial licenses.
Free digital files.
Browser-based design tools.
Digital generators and applications.
Subscription-based software and Services.
Beta versions of digital tools.
Other digital content and Services described on the website.

No physical product will be shipped unless a product page expressly states that a physical product is included.

The exact content, formats, dimensions, material thicknesses, functions, technical requirements, license and limitations of a product or Service are described on the relevant product page.

Customers must review this information before purchasing.

PRODUCT DESCRIPTIONS AND COMPATIBILITY

We make reasonable efforts to describe products and Services accurately.

Product images, renders, previews, videos and finished physical examples are provided to help customers understand the design or Service. Colors and appearance may vary depending on the customer’s screen, material, machine, software and production settings.

Digital laser cutting files may require compatible vector software and appropriate laser cutting equipment.

Customers are responsible for checking:

Included file formats.
Product dimensions.
Largest part dimensions.
Required material thickness.
Laser machine working area.
Software compatibility.
License type.
Technical requirements.
Product-specific limitations.

The final physical result may depend on material thickness, kerf, focus, machine calibration, cutting settings, glue, assembly technique and other factors outside Vector Painter’s control.

Nothing in this section excludes responsibility for a digital product or Service that materially fails to conform to its product description.

ORDERS AND CONTRACT FORMATION

Placing a product in the shopping cart does not reserve the product or conclude a contract.

The customer submits a binding order by completing checkout and selecting the final payment button.

The contract is concluded when:

Payment is successfully authorised or accepted.
Vector Painter accepts the order.
An order confirmation is issued electronically.

We may refuse or cancel an order for a valid reason, including:

Suspected fraud.
Unauthorised payment.
Incorrect pricing caused by an obvious technical error.
Violation of sanctions or applicable law.
Previous serious breach of these Terms.
Attempted resale or misuse of the Service.
Technical inability to supply the purchased product.

If we cancel a paid order before the product or Service is supplied, the applicable payment will be refunded.

Order confirmations and contractual information are sent to the email address entered during checkout. Customers are responsible for checking their Inbox and Spam or Junk folder.

PRICES, CURRENCIES AND TAXES

Product and subscription prices are displayed on the relevant product page and during checkout.

Prices may be displayed in different currencies depending on the customer’s selected country or region.

Before payment, the checkout will display the applicable price, recurring payment information and taxes or mandatory charges that we are required to collect.

VAT and other taxes may depend on:

The customer’s country.
The customer’s billing information.
Whether the customer is purchasing as a consumer or business.
Whether a valid VAT identification number is supplied.
Applicable national and international tax rules.

Customers must provide accurate location, billing and tax information.

A valid business VAT number may affect how VAT is applied where permitted by law.

Customers located outside the European Union may still be subject to local VAT, GST, sales tax or similar taxes where applicable law requires them to be collected.

PAYMENTS

Available payment methods are displayed during checkout.

By submitting payment information, you confirm that:

You are authorised to use the payment method.
The payment information is accurate.
Vector Painter and its payment providers may process the applicable payment.
In the case of a subscription, recurring payments may be processed as disclosed before purchase.

Payment information is processed by Shopify and authorised third-party payment providers. Vector Painter does not directly store complete payment card details.

If a payment is declined or reversed, access to the affected product or Service may be delayed, suspended or terminated.

DIGITAL DELIVERY

Digital products are normally delivered electronically after successful payment.

Delivery may take place through:

A download link displayed after checkout.
A download link sent by email.
Access through the customer account.
Access to an online application or Service.
Another electronic delivery method described before purchase.

Customers must provide a correct email address and keep access to the email account used for the purchase.

If a digital product or access link is not received, the customer should check the Spam or Junk folder and then contact info@vector-painter.com.

Vector Painter will provide reasonable assistance with valid delivery problems.

RIGHT OF WITHDRAWAL FOR DIGITAL CONTENT

Consumers in the European Union or European Economic Area generally have a 14-day right to withdraw from a distance contract.

For digital content not supplied on a physical medium, this right may be lost once supply begins if the customer:

Expressly requests immediate delivery before the end of the withdrawal period.
Gives prior express consent for supply to begin.
Acknowledges that the right of withdrawal will be lost once supply begins.
Receives confirmation of that consent and acknowledgement.

The required consent and acknowledgement must be provided through a separate affirmative action and are not inferred solely from acceptance of these Terms.

Where all applicable legal requirements have been satisfied, a customer cannot withdraw solely because a digital file has already been delivered, accessed or downloaded.

If the required express consent and acknowledgement were not properly obtained, or if mandatory applicable law provides otherwise, the customer may retain the statutory right of withdrawal.

DIGITAL PRODUCT CANCELLATIONS AND REFUNDS

Because downloadable digital files cannot be physically returned, one-time digital purchases are generally final after the file has been delivered, accessed or downloaded.

This does not exclude claims concerning:

A missing file.
An incorrect file.
A corrupted file.
A serious technical defect.
A product that materially differs from its description.
A duplicate or incorrect payment.
Any other mandatory legal remedy.

Depending on the circumstances and applicable law, Vector Painter may restore access, correct the file, provide a replacement, provide a price reduction or issue a full or partial refund.

Customers should normally allow Vector Painter a reasonable opportunity to investigate and correct a technical problem before requesting a refund, unless immediate termination or refund is required by applicable law.

DIGITAL FILE LICENSES

Purchasing a digital file does not transfer copyright or ownership of the design to the customer.

The customer receives a limited right to use the purchased file according to the selected license.

The applicable license may permit personal use, limited commercial use or extended commercial use, depending on the option selected before purchase.

Unless expressly permitted by the applicable license, customers must not:

Share digital files.
Resell digital files.
Redistribute digital files.
Upload files to another website or platform.
Transfer files to another person or business.
Give files away.
Sell or distribute modified versions of files.
Include files in digital bundles.
Use files to create new downloadable products.
Claim the design as their own.
Remove legally required copyright or attribution information.

Commercial production limits and attribution requirements are determined by the selected license.

VECTOR PAINTER INTELLECTUAL PROPERTY

The website and its contents are owned by or licensed to Vector Painter and are protected by copyright, trademark and other intellectual property laws.

Protected content includes, without limitation:

Digital designs.
SVG, DXF, AI, CDR and other vector files.
PDF instructions.
Product descriptions.
Product photographs.
Videos.
Renders.
Illustrations.
Logos.
Website graphics.
Software.
Application interfaces.
Source code.
Algorithms.
Documentation.
Tutorials.
Branding.

Except as expressly permitted by a purchased license or mandatory law, you may not copy, reproduce, modify, distribute, sell, license, reverse engineer, extract, scrape or commercially exploit any protected Vector Painter content or Service.

SUBSCRIPTION SERVICES

Vector Painter may offer recurring subscriptions, including the Vector Painter Nest monthly subscription.

Before completing a subscription purchase, the customer will be informed of:

The subscription price.
The billing frequency.
The amount of the initial payment.
The amount of recurring payments.
Automatic renewal.
How to cancel.
The minimum term, if any.
Applicable taxes.
Any promotional or introductory period.

Unless cancelled, a monthly subscription automatically renews every month and the selected payment method is charged the applicable recurring price.

By purchasing a subscription, the customer authorises Vector Painter and its payment provider to process the initial payment and subsequent recurring payments until the subscription is cancelled or terminated.

There is no minimum subscription term unless expressly disclosed before purchase.

SUBSCRIPTION CANCELLATION

Customers may cancel a subscription at any time without a cancellation fee.

A subscription may be cancelled:

Through the subscription management section of the customer account.
By contacting info@vector-painter.com from the email address associated with the subscription.

Cancellation normally takes effect at the end of the current paid billing period.

After cancellation:

Access continues until the end of the paid period.
No further renewal payment will be charged.
Access stops when the paid period expires.

Cancellation stops future renewals. It does not normally result in a refund for the current paid period, except where a refund is required by applicable law or expressly approved by Vector Painter.

Customers should cancel before the next billing date to prevent the next recurring payment.

RIGHT OF WITHDRAWAL FOR SUBSCRIPTIONS

EU and EEA consumers generally have a 14-day right of withdrawal from the initial subscription contract.

Where an online Service is supplied immediately, the customer may be asked to:

Expressly request that supply begins before the end of the withdrawal period.
Acknowledge that the right of withdrawal may be lost once supply begins.

The right of withdrawal will be lost only where all applicable legal requirements have been satisfied.

The statutory withdrawal right generally applies to the initial subscription contract and not separately to every automatic monthly renewal, unless mandatory applicable law provides otherwise.

Cancelling future renewal is different from exercising a statutory right of withdrawal.

Where the statutory right remains available, the customer may use the online withdrawal function made available through the website or send an unambiguous withdrawal statement to info@vector-painter.com.

SUBSCRIPTION PRICE CHANGES

A price described as a Beta Launch Price, introductory price or promotional price is not guaranteed permanently unless expressly stated otherwise.

If a temporary promotional price will automatically change, the future recurring price and the time from which it applies will be disclosed before purchase.

Vector Painter may change an existing subscription price for valid reasons, including changes in taxes, operating costs, payment processing costs, infrastructure costs, functionality or the scope of the Service.

Existing subscribers will receive clear notice by email or another durable medium at least 30 days before the first renewal charged at the new price, unless a longer period is required by applicable law.

The new price will apply only to future billing periods.

Customers may cancel the subscription before the new price takes effect.

FAILED SUBSCRIPTION PAYMENTS

If a recurring payment fails, Vector Painter or its payment provider may:

Notify the customer.
Retry the payment.
Ask the customer to update the payment method.
Temporarily suspend access to the Service.

If payment cannot be collected within a reasonable period, the subscription may be terminated.

The customer remains responsible for valid payment obligations incurred before termination.

No cancellation penalty will be charged.

VECTOR PAINTER NEST AND BETA SERVICES

Vector Painter Nest and other designated products may be supplied as Beta versions.

Beta Services are under continuous development, testing and improvement.

Because of their Beta status:

Some functions may contain errors or inaccuracies.
Temporary limitations may occur.
Processing results may vary.
Maintenance or interruptions may occur.
Features, interface elements and processing methods may change.
Performance may depend on file complexity, browser, computer, internet connection and server capacity.

Vector Painter Nest is designed for use on a desktop or laptop computer. Mobile phone use is not officially supported.

Vector Painter Nest works only with clean SVG files containing ordinary vector elements, including curves, straight lines and basic vector shapes.

SVG effects, filters, embedded raster images and other unsupported elements may not be processed correctly.

The nesting layouts are not represented as mathematically optimal solutions in every possible case. The Service is designed to provide a practical balance between nesting quality, processing accuracy and processing speed.

Customers must review exported files, geometry, dimensions, spacing, restricted areas, holding tabs and nesting results before laser cutting or committing materials to production.

The Beta designation does not exclude or reduce mandatory consumer rights concerning conformity, supply, repairs, price reductions, termination or refunds.

TECHNICAL LIMITS AND UNLIMITED USE

A subscription described as including “unlimited” use means that there is no stated monthly limit on ordinary individual use, projects or exports.

Unlimited use does not remove technical limits that may apply to an individual operation, including:

File size limits.
SVG complexity limits.
Processing time limits.
Browser or computer performance limits.
Server capacity limits.
Security restrictions.

Unlimited use does not permit:

Account sharing.
Resale of access.
Automated mass processing.
Automated scraping.
Attempts to overload the Service.
Circumvention of security or technical restrictions.

Technical limits that materially affect normal use will be disclosed on the relevant product or Service page where required.

CUSTOMER FILES AND UPLOADED CONTENT

Customers retain ownership of files they lawfully upload to a Vector Painter Service.

By uploading a file, the customer grants Vector Painter a limited, non-exclusive right to process that file only as reasonably necessary to:

Provide the requested Service.
Generate the requested output.
Maintain security.
Diagnose a reported technical problem.
Comply with applicable law.

This limited permission does not transfer ownership of the uploaded design to Vector Painter.

The customer confirms that they own or have the necessary legal rights to upload and process the file.

Customers must not upload:

Files that infringe another person’s copyright or intellectual property.
Illegal content.
Malicious code.
Content intended to damage or disrupt the Service.
Personal or confidential information that is unnecessary for using the Service.

Processing of customer files and personal data is governed by our Privacy Policy.

Customers are responsible for downloading and retaining copies of their original and exported files. Online tools should not be treated as permanent file storage or backup services.

GENERATED OUTPUTS

Subject to any rights in the original uploaded file, customers may use outputs generated from their own files for their lawful purposes.

Generating an output does not:

Transfer ownership of Vector Painter software.
Grant access to source code or algorithms.
Authorise reverse engineering.
Grant rights to any third-party content included without permission.
Remove the customer’s responsibility to verify the result.

The customer remains responsible for confirming that generated files are suitable for the intended machine, material and manufacturing process.

SERVICE CONFORMITY AND CUSTOMER REMEDIES

Vector Painter is responsible for supplying digital products and Services in conformity with the applicable contract and product description.

For digital content or a digital Service supplied continuously over a period of time, mandatory conformity obligations apply throughout the relevant supply period.

If a digital product or Service is not supplied, does not work as described or otherwise lacks conformity, the customer should contact info@vector-painter.com and provide:

The account email address.
The order or subscription number.
A clear description of the problem.
Relevant screenshots or files where reasonably necessary.
The remedy requested.

Subject to applicable law, the customer may be entitled to:

Have the digital product or Service brought into conformity.
Receive a replacement or correction.
Receive a proportionate price reduction.
Terminate the affected contract.
Receive an applicable refund.

Vector Painter will attempt to bring the digital product or Service into conformity within a reasonable time, without charge and without significant inconvenience to the consumer.

Where Czech consumer law applies, consumer complaints will be handled without undue delay and no later than 30 calendar days after the complaint is submitted, unless the customer agrees to a longer period.

UPDATES AND MODIFICATIONS TO DIGITAL SERVICES

Vector Painter may update or modify a digital Service for valid reasons, including:

Improving performance.
Improving nesting or generation results.
Adding or improving features.
Correcting errors.
Correcting security vulnerabilities.
Maintaining technical compatibility.
Adapting to new browsers or infrastructure.
Complying with legal requirements.
Preventing abuse.
Responding to increased numbers of users.

Updates necessary to maintain conformity, functionality or security will be supplied where required by applicable law.

Customers will be informed of relevant modifications in a clear and understandable manner.

If a modification negatively affects a consumer’s access to or use of a digital Service in more than a minor way, the consumer will be informed reasonably in advance by email or another durable medium.

Where required by applicable law, the affected consumer may terminate the contract without charge within 30 days after receiving the notice or after the modification takes effect, whichever is later.

SERVICE AVAILABILITY AND MAINTENANCE

We take reasonable measures to keep the website and online Services available and secure.

Temporary interruptions may occur because of:

Maintenance.
Security updates.
Software errors.
Server or network failures.
Third-party service failures.
Events outside our reasonable control.
Urgent legal or security requirements.

Where reasonably possible, planned maintenance that materially affects a paid Service will be communicated in advance.

We do not guarantee that every online Service will be completely uninterrupted or error-free at all times.

This section does not limit mandatory consumer remedies where a paid Service is unavailable or lacks conformity.

OPTIONAL AND THIRD-PARTY TOOLS

Some Services may depend on or provide access to tools, software, platforms or infrastructure operated by third parties, including Shopify, payment providers and cloud service providers.

Third-party services may be governed by their own terms and privacy policies.

Vector Painter is not responsible for independent third-party websites or services that are outside our reasonable control.

Nothing in this section excludes responsibility where applicable law makes Vector Painter responsible for the proper supply of the purchased digital product or Service.

THIRD-PARTY LINKS

The website may contain links to third-party websites.

These links are provided for convenience or reference. Vector Painter does not control all third-party websites and is not responsible for their independent content, availability, security or practices.

Customers should review the terms and privacy policies of third-party websites before using them.

USER COMMENTS, REVIEWS AND FEEDBACK

Customers may submit reviews, comments, suggestions or feedback.

The customer remains responsible for the accuracy and legality of submitted content.

Submitted content must not:

Violate another person’s rights.
Contain illegal, abusive or discriminatory material.
Contain malicious code.
Contain false or misleading statements.
Disclose another person’s personal data without permission.

By voluntarily submitting a review or feedback, the customer grants Vector Painter a non-exclusive, worldwide, royalty-free right to display, reproduce and use that review or feedback for legitimate business, promotional and Service-improvement purposes.

This permission does not apply to customer SVG files, private support attachments or confidential materials uploaded solely to use a Service or obtain technical assistance.

We may remove content that violates these Terms or applicable law.

PERSONAL INFORMATION AND PRIVACY

Personal information is processed according to our Privacy Policy:

Personal data may be processed to:

Create and maintain customer accounts.
Process orders and payments.
Deliver digital products.
Provide subscription access.
Prevent fraud and abuse.
Provide customer support.
Meet accounting, tax and legal obligations.

Agreement to these Terms does not constitute consent to receive optional marketing messages.

Marketing communications will be sent only where there is an appropriate legal basis, and customers may unsubscribe from them.

ELECTRONIC COMMUNICATIONS

By creating an account, placing an order or starting a subscription, the customer agrees to receive necessary electronic communications relating to:

Orders.
Downloads.
Account security.
Subscription renewals.
Payment failures.
Price changes.
Service changes.
Cancellations.
Withdrawal requests.
Refunds.
Technical support.
Legal or policy updates.

Transactional messages are necessary for performing the contract and are different from optional marketing communications.

Customers are responsible for maintaining a valid email address and checking their Spam or Junk folder.

PROHIBITED USES

Customers and website users must not:

Use the website or Services for an unlawful purpose.
Violate copyright, trademark or intellectual property rights.
Share or resell digital files without permission.
Share or resell subscription access.
Upload malicious software or harmful code.
Attempt to gain unauthorised access.
Interfere with website or Service security.
Bypass technical restrictions.
Scrape or automatically extract protected content.
Use bots to overload or abuse the Service.
Collect personal data without a lawful basis.
Impersonate another person.
Submit fraudulent orders or payment information.
Use the Service in violation of applicable sanctions or export restrictions.

We may suspend or terminate access where reasonably necessary to prevent or respond to prohibited use.

CORRECTIONS, ERRORS AND OMISSIONS

The website may occasionally contain typographical errors, incorrect prices, outdated information or technical omissions.

We may correct an error and update information.

If an obvious pricing or product information error affects an order before supply, we may contact the customer to confirm the corrected order or cancel the order and provide a refund.

We will not retroactively increase the price of an already completed one-time purchase.

Subscription price changes are handled according to Section 18.

REFUSAL, SUSPENSION AND TERMINATION OF SERVICE

Vector Painter may refuse, restrict, suspend or terminate an account, order or Service for a valid reason, including:

Non-payment.
Fraud.
Security risks.
Illegal activity.
Account sharing.
Resale of access.
Copyright infringement.
Serious or repeated violations of these Terms.
Attempts to damage or disrupt the Service.
Legal or regulatory requirements.

Where reasonably possible and appropriate, we will notify the customer and provide an opportunity to resolve the issue.

Immediate suspension may occur where necessary to prevent fraud, security threats, unlawful activity or material harm.

Termination does not remove payment obligations lawfully incurred before termination.

Mandatory consumer rights remain unaffected.

DISCONTINUATION OF A PAID SERVICE

Vector Painter may permanently discontinue a digital Service for valid operational, legal or commercial reasons.

Where reasonably possible, customers will be notified in advance.

If a prepaid Service is permanently discontinued before the end of the paid period for reasons not caused by the customer, Vector Painter will provide an appropriate refund for the unused prepaid period.

This does not limit additional mandatory remedies.

DISCLAIMER AND CUSTOMER RESPONSIBILITY

Digital designs and online tools are intended to assist customers with creative and manufacturing workflows.

Customers remain responsible for:

Selecting appropriate materials.
Measuring actual material thickness.
Configuring laser machine settings.
Checking kerf and scale.
Testing files before full production.
Following machine manufacturer instructions.
Following workplace and laser safety rules.
Reviewing generated and exported files.
Confirming that the final result is suitable for its intended purpose.

Vector Painter does not guarantee a specific commercial result, amount of material savings, production income or sales performance.

Nesting results are not guaranteed to be mathematically optimal in every possible case.

Nothing in this section limits responsibility for a product or Service that fails to conform to the contract or any other responsibility that cannot legally be excluded.

LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability for:

Fraud or fraudulent misrepresentation.
Intentional misconduct.
Gross negligence where liability cannot be excluded.
Death or personal injury caused by negligence where liability cannot be excluded.
Breach of mandatory consumer rights.
Any other liability that cannot legally be excluded or limited.

To the maximum extent permitted by applicable law, Vector Painter is not responsible for indirect or consequential business losses caused by:

Incorrect customer machine settings.
Incorrect material selection.
Failure to verify dimensions or geometry.
Use of unsupported software or hardware.
Unauthorised modification of files.
Use outside the product description or license.
Loss of files where the customer failed to keep backups.

For customers acting wholly in the course of business, and only to the extent permitted by law, Vector Painter’s total liability relating to a specific one-time product will not exceed the amount paid for that product.

For business subscription customers, total liability relating to the subscription will not exceed the subscription payments made during the 12 months preceding the event giving rise to the claim.

These limitations do not apply to consumers where they would reduce mandatory statutory rights.

INDEMNIFICATION BY BUSINESS USERS

If you use the website, digital products or Services entirely for business purposes, you agree, to the extent permitted by law, to compensate Vector Painter for reasonable losses, claims and expenses resulting directly from:

Your material breach of these Terms.
Your unlawful use of the Service.
Your infringement of another person’s intellectual property.
Content you uploaded without the required legal rights.
Your unauthorised resale or distribution of digital files.

This section does not apply to consumers to the extent that such an obligation would be prohibited or unfair under applicable consumer law.

FORCE MAJEURE

Vector Painter is not responsible for a delay or failure caused by events outside its reasonable control, including major internet outages, cloud infrastructure failures, natural disasters, war, government restrictions, cyberattacks, power failures or similar events.

We will take reasonable steps to reduce the impact and restore the affected Service.

This section does not exclude refunds, price reductions or other remedies required by mandatory law.

CHANGES TO THESE TERMS

We may update these Terms to reflect:

Changes in law.
Changes to products or Services.
New subscription options.
Security requirements.
Payment or tax changes.
Business or operational changes.

The current version will be published on this page with an updated date.

Changes will not retroactively reduce rights acquired under an already completed one-time purchase.

Material changes affecting an active subscription or continuing digital Service will be communicated in advance by email or another durable medium where required by applicable law.

If a material change adversely affects an active consumer subscription, the consumer may cancel or terminate the subscription as provided by applicable law.

GOVERNING LAW

These Terms and contracts concluded through vector-painter.com are governed by the laws of the Czech Republic.

If the customer is a consumer habitually resident in another country, this choice of law does not deprive the customer of mandatory consumer protections provided by the law of that country.

Nothing in these Terms restricts a consumer’s right to bring proceedings before a court that has jurisdiction under applicable consumer law.

ALTERNATIVE DISPUTE RESOLUTION

Customers are encouraged to contact Vector Painter first at info@vector-painter.com so that we can attempt to resolve the dispute directly.

If a consumer dispute cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court dispute resolution to:

This does not affect the consumer’s right to bring the matter before a competent court.

SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary.

The remaining provisions will continue in effect.

NO WAIVER

If Vector Painter does not immediately enforce a provision of these Terms, this does not mean that the provision or any related right has been waived.

ENTIRE AGREEMENT

These Terms, together with the policies, product descriptions, license terms and subscription conditions referenced in them, form the agreement between Vector Painter and the customer regarding the applicable product or Service.

They replace prior statements relating to the same subject, except for rights already acquired under an existing contract.
