Commercial License Terms and Conditions

Author & Licensor: Ivan Bilous (VectorPainter)

Definitions

"Design" or "Digital File" refers to the original vector or raster artwork, 3D model, cut file, or any other digital creation sold by Ivan Bilous.
"You" or "Licensee" refers to the individual or business purchasing or using the file under license.
"Physical Product" means a tangible, manufactured object created using the licensed design (e.g., laser-cut model, printed material).
"Third Party" refers to any person or company not directly holding a valid license (e.g., print shop, subcontractor).
"Attribution" means a clear credit given to the creator as required under the terms of the license, using the phrase “Design © Ivan Bilous.”

1. Overview

This license is non-exclusive. The same design may be licensed to multiple users under the same or different terms.

By purchasing or downloading any digital file from Ivan Bilous ("VectorPainter"), you are granted a limited license to use the file under the following terms and conditions. This license is not a transfer of copyright and does not grant ownership of the design. All digital files are protected by international copyright law.

2. License Types

There are four types of licenses available:

2.1 Personal License

Use for non-commercial, personal, hobby, or educational purposes only.
Allowed uses: gifts, school projects, classroom demonstrations, non-commercial exhibitions.
May be used in libraries, community centers, and therapeutic environments.
You may apply for a free extended personal license for verified educational or social initiatives.
No commercial sale, distribution, or promotional use is permitted.
Attribution is required if the project is published or shown publicly: “Design © Ivan Bilous”.

2.2 Starter Commercial License (up to 30 units)

Permits production and sale of up to 30 physical items derived from the licensed design.
Attribution is required: "Design © Ivan Bilous".
If the design is modified, you must include: “Based on © Ivan Bilous design”.

2.3 Commercial License (up to 100 units)

Permits production and sale of up to 100 physical items.
Attribution is required: "Design © Ivan Bilous".
If the design is modified, you must include: “Based on © Ivan Bilous design”.

2.4 Extended Commercial License (unlimited units)

Permits unlimited production and sale of physical items.
Attribution is not mandatory but is appreciated.
If the design is modified, you must include: “Based on © Ivan Bilous design”.

3. General Restrictions

This license is written in English and shall be interpreted according to the meaning of the English terms.

Use of the design in blockchain-based assets (e.g., NFTs), or for the purpose of training artificial intelligence models, is prohibited.

The licensor reserves the right to request reasonable evidence of license compliance if there is a legitimate concern regarding potential overproduction or unauthorized use. This may include, but is not limited to, proof of production volume, sales records, or documentation of third-party manufacturing services. Failure to provide such information upon request may result in suspension or termination of the license.

This license is non-exclusive, non-transferable, and revocable. You are granted the right to use the digital file according to the specific terms of your selected license type. Ownership of the digital file remains with the author, Ivan Bilous. You may not assign, sublicense, lease, sell, or otherwise transfer this license or any rights under it to any other party, in whole or in part. These apply to all license tiers unless explicitly noted.

3.1 Copyright & Ownership

All files remain the intellectual property of Ivan Bilous.
Purchasing a license grants limited usage rights only. It does not transfer copyright, ownership, or exclusive rights.
You may not claim authorship or originality of the design, even if modified.

3.2 Prohibited Uses (Explained)

You may NOT:

Resell, share, or redistribute the digital file: The file may not be shared with others, uploaded to public servers, sold in any form (including modified versions), or included in other products.
Create competing digital products: You may not use any part of the file to develop or sell digital items such as SVG bundles, design templates, cut files, or similar products.
Register as trademark or copyright: You are prohibited from registering the design or any physical item made from it as your intellectual property.
Transfer the license: Licenses are granted to one user or business and may not be transferred to subcontractors, partners, clients, or manufacturers.

3.3 License Scope

One license is granted per individual or single registered business entity.
Each digital file requires its own license.
A separate license is required for each user, team member, or client.

3.4 Modifications

You may modify the file for permitted personal or commercial use within your license scope.
Modification does not create new ownership or exempt you from attribution requirements.
When a design is modified, you must include the statement: “Based on © Ivan Bilous design”.
Any modifications must not violate any applicable laws, or promote or involve content that is discriminatory, offensive, defamatory, or otherwise inappropriate on the grounds of morality, religion, ethnicity, gender, disability, or similar protected characteristics.

3.5 Use of Instruction Files

You may include printed versions of the PDF assembly instructions with your physical products.
The PDF must remain unaltered except for the removal of the author's contact information (such as email or phone number), and the deletion of any final promotional or marketing page if present.
Distribution of the digital version of the PDF is not permitted.

4. Working with Third Parties

You may work with third-party services (e.g., laser cutting workshops or print vendors) to manufacture physical products based on the licensed design, under the following conditions:

The digital file must not be transferred, sold, or publicly distributed to any third party.
If the nature of the service requires temporary access to the file (e.g., file upload for production), this must be done solely for the purpose of executing the specific task, and the file must not be stored, reused, modified, or distributed by the third party.
The third party must act exclusively as a service provider and must not claim any rights to the file or product.
You must ensure that any third party you engage is fully aware of and agrees to comply with these terms.
You remain solely and fully responsible for any misuse or violation by any third party granted access to the file.

5. Attribution Requirements

Where attribution is required, it must be clearly stated on product listings, packaging, printed material, or social media posts.

6. Termination

This license will be immediately terminated if:

You violate any of the terms outlined herein.
You resell, redistribute, or unlawfully share the digital files.
You falsely claim ownership or authorship of the design.

Upon termination of the license, all granted rights shall immediately cease. No refunds or reimbursements will be issued for terminated licenses due to violations.

Ivan Bilous reserves the right to pursue legal action and compensation for any unauthorized use of his intellectual property.

7. Prohibited Use of Visual Materials

You are not permitted to use, reproduce, publish, or share any promotional images, videos, or photographs created by Ivan Bilous without prior written permission. This includes using such materials for marketing, social media, product listings, or any other public or commercial purpose.

8. Governing Law

This license shall be governed by and construed in accordance with the laws of the Czech Republic. Any disputes arising under or in connection with this license shall be subject to the exclusive jurisdiction of the courts in Prague, Czech Republic.

10. Acceptance

By purchasing, downloading, or using any digital file from Ivan Bilous (VectorPainter), you confirm that you have read, understood, and agree to be legally bound by the terms of this license.

All use of files is subject to these terms.
