Definitions
For the purposes of this License Agreement, the following terms shall have the meanings set out below.
“Design” or “Digital File” means the original vector or raster artwork, 3D model, laser cut file, cut file, template, instruction file, or any other digital creation sold or distributed by Ivan Bilous.
“You” or “Licensee” means the individual, business, organization, or legal entity purchasing, downloading, accessing, or using the Design under license.
“Physical Product” means a tangible, finished, manufactured object created using the licensed Design, including but not limited to laser-cut models, wooden decorations, printed materials, assembled products, craft items, or similar physical goods.
“Third Party” means any person, company, workshop, subcontractor, print shop, laser cutting service, manufacturer, client, partner, or other entity that does not directly hold a valid license for the Design.
“Attribution” means a clear credit given to the creator as required under the terms of the selected license, using the phrase: “Design © Ivan Bilous”.
1. Overview
This license is non-exclusive. The same Design may be licensed to multiple users under the same or different terms.
By purchasing, downloading, accessing, or using any Digital File from Ivan Bilous or VectorPainter, you are granted a limited license to use the file under the terms and conditions set out in this document. This license is not a transfer of copyright and does not grant ownership of the Design.
All Digital Files remain the intellectual property of Ivan Bilous and are protected by copyright law and applicable international intellectual property laws.
Prices, taxes, VAT, duties, platform fees, and other purchase-related obligations are governed separately and are determined at the time of purchase.
2. License Types
There are four main license types available.
2.1 Personal License
The Personal License permits use of the Design for non-commercial, personal, hobby, educational, charitable, therapeutic, or community purposes only.
Permitted uses may include personal projects, gifts, school projects, classroom demonstrations, libraries, community centers, makerspaces, art therapy, rehabilitation programs, volunteer initiatives, and non-commercial exhibitions.
No commercial sale, distribution, advertising, marketplace listing, or promotional use of finished Physical Products is permitted under the Personal License.
You may apply for a free extended personal-use license for verified educational, social, charitable, or community initiatives.
Attribution is required if the project is published online, shown publicly, displayed in an exhibition, or shared on social media. The required attribution is:

2.2 Starter Commercial License
The Starter Commercial License permits small commercial use of the licensed Design.
If you personally produce finished Physical Products yourself using one laser cutting machine, you may produce and sell an unlimited number of finished Physical Products made from the licensed Design.
If production is outsourced, shared with another person or business, carried out by a Third Party, or made using more than one laser cutting machine, the Starter Commercial License permits production and sale of up to 30 finished Physical Products in total.

Sharing, reselling, uploading, copying, transferring, or redistributing the Digital File itself is not permitted.
2.3 Commercial License
The Commercial License permits production and sale of up to 100 finished Physical Products made from one licensed Design.
This license is intended for handmade businesses, craft shops, workshops, and small-batch commercial production.

Sharing, reselling, uploading, copying, transferring, or redistributing the Digital File itself is not permitted.
2.4 Extended Commercial License
The Extended Commercial License permits unlimited production and sale of finished Physical Products made from one licensed Design.
Attribution is not mandatory under the Extended Commercial License, but it is appreciated. If attribution is given, the following format may be used:

Sharing, reselling, uploading, copying, transferring, or redistributing the Digital File itself is not permitted.
3. General Restrictions
This license is written in English and shall be interpreted according to the meaning of the English terms.
This license is non-exclusive, non-transferable, and revocable. You are granted the right to use the Digital File only according to the specific terms of your selected license type.
Ownership and copyright of all Digital Files remain with Ivan Bilous. You may not assign, sublicense, lease, sell, transfer, or otherwise give this license or any rights under it to any other party, in whole or in part.
Use of the Design, Digital File, product image, preview, instruction file, or any related content in blockchain-based assets, NFTs, cryptocurrency-related assets, artificial intelligence training datasets, machine learning datasets, generative AI systems, or automated design-generation tools is prohibited.
Use, sale, distribution, download, access, or commercial exploitation of the files in sanctioned territories, including the territory of the Russian Federation and by its citizens, is prohibited.
3.1 Copyright and Ownership
All files remain the intellectual property of Ivan Bilous.
Purchasing a license grants limited usage rights only. It does not transfer copyright, ownership, authorship, or exclusive rights.
You may not claim authorship, originality, or ownership of the Design, even if the Design has been modified.
You may not register the Design, modified Design, derivative Design, or any Physical Product made from the Design as your trademark, copyright, patent, design registration, or exclusive intellectual property.
3.2 Prohibited Uses
You may not resell, share, upload, copy, transfer, give away, or redistribute the Digital File in any form.
You may not sell, share, upload, copy, transfer, give away, or redistribute modified versions of the Digital File.
You may not include the Digital File or any part of it in other digital products, SVG bundles, DXF bundles, laser cut file packs, design templates, clipart packs, vector packs, AI-generated design packs, or downloadable products.
You may not create competing digital products based on the Digital File or any part of the Digital File.
You may not claim the Design as your own original work.
You may not transfer the license to subcontractors, partners, clients, manufacturers, print shops, laser cutting workshops, or any other Third Party.
You may not use the Design in illegal, offensive, discriminatory, defamatory, hateful, misleading, unethical, or otherwise inappropriate projects.
3.3 License Scope
One license is granted to one individual or one registered business entity.
Each Digital File or Design requires its own license.
A separate license is required for each user, team member, client, business, or legal entity using the file.
Buying one license for one Design does not grant rights to use other Designs commercially.
3.4 Modifications
You may modify the Digital File only for permitted personal use or for producing finished Physical Products within the scope of your selected license.
Modification does not create new ownership, authorship, copyright, or exclusive rights.
Modification does not remove attribution requirements if your selected license requires attribution.
When a Design is modified and attribution is required, you must include the following statement:

Any modifications must not violate applicable laws or promote content that is discriminatory, offensive, defamatory, hateful, misleading, unethical, or inappropriate on the grounds of morality, religion, ethnicity, nationality, gender, disability, age, or similar protected characteristics.
3.5 Use of Instruction Files
You may include printed versions of the PDF assembly instructions with finished Physical Products.
The PDF must remain unaltered except for removing the author’s contact information, such as email or phone number, and removing any final promotional or marketing page if present.
Distribution, sharing, uploading, resale, or transfer of the digital PDF file is not permitted.
4. Marketplace Restrictions
Selling finished Physical Products created from the licensed files on major mass marketplaces, including but not limited to Temu, eBay, Amazon, AliExpress, Walmart Marketplace, and similar platforms, is prohibited without prior written permission from Ivan Bilous.
Selling finished Physical Products on Etsy may be permitted only within the exact limits of the purchased license and only if attribution and all other license terms are followed.
5. Working with Third Parties
You may work with Third Party services, such as laser cutting workshops, print vendors, subcontractors, or manufacturing services, to manufacture finished Physical Products based on the licensed Design, subject to the conditions below.
The Digital File must not be sold, transferred, publicly distributed, or permanently shared with any Third Party.
If the service requires temporary access to the Digital File, such as file upload for production, access must be limited strictly to completing the specific production task.
The Third Party must not store, reuse, modify, copy, sell, redistribute, upload, or claim rights to the Digital File or the Design.
The Third Party must act only as a service provider and must not claim any ownership or rights to the Design or file.
You must ensure that any Third Party you use is aware of these terms and agrees to comply with them.
You remain solely and fully responsible for any misuse, unauthorized copying, or violation by any Third Party that receives access to the file.
If Third Party production, subcontracting, or outsourced manufacturing is used under the Starter Commercial License, the production limit is up to 30 finished Physical Products in total.
6. Attribution Requirements
Where attribution is required, it must be clearly stated on product listings, packaging, printed materials, exhibition descriptions, social media posts, marketplace listings, or other public-facing materials.

Attribution must be visible and reasonably easy to find. It must not be hidden in a way that makes the creator credit unclear to customers or viewers.
7. License Verification and Proof of Purchase
Ivan Bilous reserves the right to request reasonable evidence of license compliance if there is a legitimate concern regarding unauthorized use, overproduction, redistribution, missing attribution, marketplace misuse, or any other possible violation of these terms.
This may include, but is not limited to, proof of purchase, order number, purchase date, email address used for purchase, marketplace or website where the file was purchased, selected license type, production quantity, sales volume, product listings, sales records, production documentation, or documentation of Third Party manufacturing services.
You agree to provide the requested information within a reasonable time so that the license status can be verified.
Failure to provide reasonable proof of purchase, license type, or license compliance upon request may be treated as unauthorized use and may result in suspension or termination of the license.
8. Termination
This license will be immediately terminated if you violate any of the terms described in this document.
This license will also be terminated if you resell, redistribute, upload, transfer, copy, or unlawfully share the Digital Files; falsely claim ownership or authorship of the Design; exceed the production or sales limits of your selected license; or fail to provide reasonable proof of purchase or license compliance when requested.
Upon termination of the license, all granted rights shall immediately cease. You must stop using the Digital File and stop producing, selling, promoting, or distributing any products based on the Design.
No refunds or reimbursements will be issued for licenses terminated due to violations.
Ivan Bilous reserves the right to pursue legal action, compensation, damages, and other remedies for any unauthorized use of his intellectual property.
9. Prohibited Use of Visual Materials
You are not permitted to use, reproduce, publish, copy, download, edit, share, or distribute any promotional images, videos, renders, product photos, previews, mockups, descriptions, or other visual or written materials created by Ivan Bilous without prior written permission.
This includes using such materials for marketing, social media, product listings, online marketplaces, advertising, packaging, catalogs, websites, or any other public or commercial purpose.
If you sell finished Physical Products made from the Design under a valid commercial license, you should use your own photos and videos of your own finished Physical Products.
10. Governing Law
This license shall be governed by and construed in accordance with the laws of the Czech Republic.
Any disputes arising under or in connection with this license shall be subject to the exclusive jurisdiction of the courts in Prague, Czech Republic.

By purchasing, downloading, accessing, opening, or using any Digital File from Ivan Bilous or VectorPainter, you confirm that you have read, understood, and agreed to be legally bound by these Commercial License Terms and Conditions.
